Licensing terms and conditions of use
of the library music

Here are the terms and conditions that cover the use of music from the Picture Lock Music library (the “library”),www.picturelockmusic.com. By accepting these terms the user agrees to abide by them and become a Licensee. By continuing to use the Picture Lock Music web site and the licensor’s music services (including the use of music supplied via means other than the website e.g. CD, remote “cloud-based” website), the Licensee agrees to be bound by these terms. If the user/Licensee does not agree with these terms they are not permitted to access the library and download any content. If the Licensee has any queries about the terms of the licence they should immediately contact Picture Lock Music for clarification.

The following information details the licensing terms that will apply to any music licensed from Picture Lock Music. For the avoidance of any doubt, all rights in the picture Lock Music library belong to Picture Lock Music Ltd. The Licensee agrees to make every effort to protect the Licensor’s rights and further agrees to indemnify the Licensor against any losses or claims arising from the use of the music. Unauthorised public performance, broadcast, communication to the public, copying or distribution are prohibited. The use of the music within the library is subject at all times to having a current license issued by Picture Lock Music prior to any exploitation or use of the music in any relevant television
production, recording or other audio visual production. The music tracks downloaded from the library are licensed to the Licensee (not sold by Picture Lock Music), for the purpose of being used in audio-visual productions. The licence granted will be a non-exclusive, non-transferable, licence. The Licensee is NOT permitted to share, re-license, reproduce, or otherwise transfer music from the library to any other individual or company. If the Licensee requires any clarification about the permissible usage of the music selected (relating to the individual tracks, the amount of music permitted, the type of use permitted or any matter relating to the use of the music) contact Picture Lock Music.
The following uses of the music from the library are not permitted under the licence: advertisements and commercials; web-only audio-visual production (broadcast programmes subsequently available via the website are permitted e.g. ITV Player or BBCiPlayer), usage on a website, within an app or any digital device. The music cannot be used as the main title, in a commercially available, multi-duplicated DVD, albums or other commercial product without Picture Lock Music’s permission. There are exceptions to these exclusions and Licence extensions for uses not covered by this agreement are available on request and are normally granted.
All music that is downloaded from the website (or obtained via any other means of delivery from the Licensor) and is subsequently used in any audio visual production must be included in the cue sheets relating to that production. All the relevant details of the music including the name of the track, the composer and length of usage must be included. The information on the cue sheets must be submitted to the broadcasters screening the production in the case of television and the relevant collection society in the case of a production screened in cinemas.
The Licensee is not allowed to publish the library music as its own, or as credited to the Licensee.  If the Licensee wishes to add lyrics, poetry, vocals or instrumental accompaniment to any of the library music Picture Lock Music must be contacted to obtain a license based on the Licensee’s exact requirements. If the Licensee has any queries about the terms of the licence relating to this matter they should immediately contact Picture Lock Music for clarification.
The Licensee will not disclose user names or passwords used in accessing the Picture Lock Music library web site to any unauthorised party and will maintain such details as confidential. The Licensee will exercise due diligence and maintain
strict safeguards on all music received from the library to prevent unauthorized use.
These Terms of Use constitute the entire agreement between the Licensee and Picture Lock Music. Failure by the Licensor to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is found by a court of law to be invalid, the parties agree that the other provisions of these Terms of Use remain in full force and effect.
The Licensee will indemnify, save, hold harmless and defend Picture Lock Music from and against any claims, demands, suits, damages, liabilities and all reasonable expenses, including legal fees, against or suffered by Picture Lock Music with respect to any matter that arises as a result of a breach of this agreement by the Licensee.
